End User License Agreement

Acknowledgement of Country

Bonnum Lux Group acknowledges the Ngunnawal people, Traditional Custodians of the land on which we work, and pays our respects to Elders past, present, and emerging.

1. Acceptance of Terms

This End User License Agreement ("EULA") is a binding legal agreement between you ("User," "you," or "your") and Bonnum Lux Group Pty Ltd (ABN 95 693 729 207) ("Bonnum Lux Group," "we," "us," or "our"), the owner and operator of Fargeaux (the "Application"). By downloading, installing, or using the Application, you agree to be bound by this EULA. If you do not agree to these terms, do not download, install, or use the Application.

This EULA is concluded between you and Bonnum Lux Group only, and not with Apple Inc. ("Apple") or any other distribution platform through which you may have obtained access to the Application. Bonnum Lux Group, not Apple, is solely responsible for the Application and its content. This EULA applies to all users of the Application worldwide, regardless of the country from which the Application is downloaded or used, subject to mandatory local consumer protection laws that cannot be excluded by contract.

2. License Grant

Subject to your compliance with this EULA, Bonnum Lux Group grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Application on compatible devices that you own or control. Where the Application is obtained from the Apple App Store, this license is also subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions, and the Application may be accessed by other accounts associated with your Apple Account via Family Sharing or Legacy Contacts. Where the Application is obtained from the Google Play Store, this license is subject to Google Play's Terms of Service.

This license is granted for your personal, non-commercial use only. The scope of Content you may access is determined by the entitlement you have acquired, whether for a single country or for all countries.

3. Restrictions

You agree NOT to:

Bonnum Lux Group reserves the right to suspend or terminate your access immediately if it determines, in its sole discretion, that you have violated these restrictions, with no refund obligation. These restrictions apply to every user of the Application, including users accessing the Application under a free trial and users who have not created a Fargeaux account. By downloading, installing, or using the Application in any way, including any free trial, you agree to be bound by these restrictions whether or not you have created an account or purchased a Membership.

• (a) Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the Application or its content;
• (b) Reproduce, redistribute, transmit, broadcast, publicly display, sell, license, sublicense, or otherwise make available any portion of the Application's content (including but not limited to flashcards, road signs, quiz questions, driving tips, audio recordings, or other educational materials) to any third party;
• (c) Use any automated means, including bots, scrapers, crawlers, or data-mining tools, to access, collect, or extract content from the Application;
• (d) Take screenshots, screen recordings, or other captures of Application content for the purpose of redistribution, public sharing, or republication;
• (e) Use the Application for any unlawful, fraudulent, or unauthorised purpose;
• (f) Attempt to interfere with or disrupt the Application's operation, security, or integrity;
• (g) Share, transfer, sell, or sublicense your account credentials or entitlement to any other person.

4. Educational Purpose Only — Safety Disclaimer

Fargeaux is provided strictly as educational reference material to support international travellers in familiarising themselves with road signs, road rules, and driving concepts relevant to the destination country or countries covered by the version or modules of the Application they are accessing.

5. Intellectual Property

All content within the Application — including but not limited to flashcards, road signs, quiz questions, driving tips, illustrations, audio recordings, written content, software code, design elements, trademarks, and trade dress — is the exclusive property of Bonnum Lux Group or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.

The FARGEAUX name and logo are trademarks of Bonnum Lux Group, with applications filed at IP Australia (Classes 9 and 41) and pending in additional jurisdictions. No rights to the Application's content are transferred to you under this EULA except for the limited license expressly granted in Section 2.

6. Account and Access

Access to paid Content requires both a valid Fargeaux account and an active Membership or other valid entitlement issued by Bonnum Lux Group. A limited free trial may be made available without a Fargeaux account. A Membership may grant access to a single country or to all countries, as described in our Terms of Service.

Memberships are sold via fargeaux.com, the Apple App Store, and the Google Play Store. Access to the Application's content is granted upon purchase through any of these channels and is managed by Bonnum Lux Group through our entitlement system. You are responsible for safeguarding your account credentials and for all activity occurring under your account. You agree to notify support@fargeaux.com immediately if you suspect unauthorised access to your account.

7. Refunds

Refunds for purchases made via fargeaux.com are subject to Bonnum Lux Group's Refund Policy, available at fargeaux.com/refund-policy.

Refunds for purchases made via the Apple App Store or Google Play Store are subject to those platforms' respective refund processes and policies. Bonnum Lux Group has limited or no ability to process refunds for in-app purchases after the platforms' automatic refund windows have closed.

8. Maintenance, Support, and Warranty

Bonnum Lux Group is solely responsible for providing maintenance and support services for the Application, as may be required from time to time. Apple has no obligation whatsoever to provide maintenance or support services for the Application. Maintenance and support enquiries should be directed to support@fargeaux.com.

To the maximum extent permitted by applicable law, the Application is provided "as is" and "as available" without warranty of any kind, whether express, implied, statutory, or otherwise. Bonnum Lux Group disclaims all warranties not expressly stated in this EULA, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot be lawfully excluded under the Australian Consumer Law. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Bonnum Lux Group.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• (a) Bonnum Lux Group will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of business, or loss of goodwill, arising from or in connection with your use of the Application;
• (b) Bonnum Lux Group's total aggregate liability to you under or in connection with this EULA, whether in contract, tort (including negligence), under statute, or otherwise, is limited to the greater of: (i) the amount you paid for your Membership or other entitlement in the twelve (12) months prior to the event giving rise to the claim; or (ii) AUD $200;
• (c) Nothing in this EULA excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be lawfully excluded under the Australian Consumer Law or other applicable consumer protection legislation.

10. Product Liability and Third-Party Claims

You acknowledge and agree that Bonnum Lux Group, not Apple, is responsible for addressing any claims relating to the Application or your possession and/or use of it, including but not limited to:

In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, Bonnum Lux Group, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.

• (a) Product liability claims;
• (b) Any claim that the Application fails to conform to any applicable legal or regulatory requirement;
• (c) Claims arising under consumer protection, privacy, or similar legislation.

11. Legal Compliance

You represent and warrant that:

• (a) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
• (b) You are not listed on any U.S. Government list of prohibited or restricted parties, including the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Commerce Department's Denied Persons List;
• (c) You will comply with all applicable third-party terms of agreement when using the Application, including your mobile data service agreement and any other applicable terms.

12. Privacy

Your use of the Application is subject to Bonnum Lux Group's Privacy Policy, available at fargeaux.com/privacy. By using the Application, you consent to the data collection, processing, and storage practices described in the Privacy Policy.

13. Termination

This EULA is effective until terminated. Bonnum Lux Group may terminate this EULA and your access to the Application at any time, with or without cause, with or without notice, if Bonnum Lux Group determines in its sole discretion that you have violated this EULA or that termination is otherwise warranted.

Upon termination:

• (a) Your license to use the Application is immediately revoked;
• (b) You must cease all use of the Application and delete all copies from your devices;
• (c) Sections 3, 4, 5, 9, 10, 11, 14, 16, and 17 of this EULA will survive termination.

14. Third-Party Beneficiary

You and Bonnum Lux Group acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

15. Changes to this EULA

Bonnum Lux Group reserves the right to modify this EULA at any time. We will notify you of material changes by posting an updated version at fargeaux.com/eula and updating the "Last Updated" date. Where required by law, we will provide additional notice through the Application or by email. Continued use of the Application after such modifications constitutes your acceptance of the modified EULA.

16. Governing Law and Dispute Resolution

This EULA is governed by the laws of the Australian Capital Territory, Australia, without regard to its conflict of laws principles. The parties submit to the exclusive jurisdiction of the courts of the Australian Capital Territory for the resolution of any disputes arising under or in connection with this EULA.

Nothing in this section excludes, restricts, or modifies any right you may have under the Australian Consumer Law to bring proceedings in a court of competent jurisdiction in your state or territory of residence.

17. General

• (a) Severability: If any provision of this EULA is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
• (b) Waiver: No failure or delay by Bonnum Lux Group in exercising any right under this EULA will operate as a waiver of that right, and no single or partial exercise will preclude any other or further exercise.
• (c) Assignment: You may not assign, transfer, or sublicense this EULA or your rights under it without Bonnum Lux Group's prior written consent. Bonnum Lux Group may assign this EULA without restriction.
• (d) Entire Agreement: This EULA, together with the Privacy Policy and Refund Policy, constitutes the entire agreement between you and Bonnum Lux Group regarding the Application and supersedes all prior agreements and understandings.
• (e) Headings: Section headings are for convenience only and do not affect interpretation.
