Acknowledgement of Country

Bonnum Lux Group acknowledges the Ngunnawal people, Traditional Custodians of the land on which we work, and pays our respects to Elders past, present, and emerging.

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of Fargeaux (the "Application") and the website at fargeaux.com (the "Website"), both operated by Bonnum Lux Group Pty Ltd (ABN 95 693 729 207) ("Bonnum Lux Group," "we," "us," "our").

By accessing or using the Application or Website, purchasing a Fargeaux membership, or creating a Fargeaux account, you agree to be bound by these Terms. If you do not agree, do not access or use the Application or Website. These Terms apply to all users of the Application and Website worldwide, regardless of the country from which the Application or Website is accessed, subject to mandatory local consumer protection laws that cannot be excluded by contract.

2. Definitions

• (a) "Application" means the Fargeaux mobile application, including all versions for iOS and Android, and any updates, upgrades, or modifications;
• (b) "Website" means fargeaux.com and any subdomains operated by Bonnum Lux Group;
• (c) "Content" means all flashcards, road signs, quizzes, driving tips, audio recordings, illustrations, and other educational materials provided through the Application;
• (d) "Membership" means a valid entitlement issued by Bonnum Lux Group that grants access to the Content, whether for a single country or for all countries, including any Safety Pioneer entitlement;
• (e) "Account" means your Fargeaux user account, authenticated via email and password or magic link.

3. Eligibility

You must be at least 16 years old to create an Account and use the Application. By using the Application, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract under the laws of your jurisdiction. If you are using the Application on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

4. Account Registration

To purchase a Membership and to access paid Content, you must create an Account. A limited free trial may be offered without an Account. When you create an Account, you agree to:

• Provide accurate, current, and complete information at registration
• Maintain and promptly update your information if it changes
• Safeguard your account credentials and not share them with any third party
• Notify us immediately at support@fargeaux.com of any unauthorised access or suspected security breach

5. Description of Service

Fargeaux is an educational application designed to help international travellers familiarise themselves with road signs, road rules, and driving concepts relevant to destination countries covered by the Application.

Important Safety Disclaimer: Fargeaux is provided strictly as educational reference material. It is NOT a substitute for licensed driving instruction, official government driver education, any official highway code or government driver guide of any country, or supervised practical driving experience. Use of the Application does not certify you as fit to drive in any jurisdiction. You remain solely responsible for compliance with all applicable road traffic laws in any jurisdiction in which you operate a vehicle. See the End User License Agreement at fargeaux.com/eula for the full safety disclaimer and your acknowledgement of these limitations.

6. Purchase Channels and Pricing

Memberships are available for purchase through three channels:

All purchases are subject to the pricing displayed at the time of purchase. Prices may vary by region based on the relevant platform's currency conversion and regional pricing structures. For purchases made via the Apple App Store or Google Play Store, those platforms' own terms of service and payment terms also apply to your transaction.

What you can purchase. Fargeaux is offered as follows:

• Free trial: limited access to the Application for a fixed period (currently 24 hours) at no cost and with no payment details required. When the trial ends, a Membership is required to continue accessing paid Content;
• Single-country Membership: a one-time purchase granting lifetime access to the Content for one country you select;
• All-countries Membership: a one-time purchase granting lifetime access to the Content for every country we offer, including countries added in the future;
• Upgrade: if you hold a single-country Membership, you may upgrade to an all-countries Membership by paying the difference between the two prices displayed at the time of upgrade.

Purchasing additional single-country Memberships is not required and is not the intended path to accessing multiple countries; the upgrade described above is that path. "Lifetime" means for as long as we operate the Application and the relevant Content remains available, and does not oblige us to operate the Application indefinitely.

7. Refunds

Refund policies vary by purchase channel. For full details, see our Refund Policy at fargeaux.com/refund-policy. In summary:

If you are a consumer in the European Union or United Kingdom, you have a statutory right to withdraw from your purchase within 14 days. This statutory right applies in addition to the policies above.

• fargeaux.com purchases: 14-day discretionary refund window, with conditions
• Apple App Store purchases: subject to Apple's refund process (typically 90-day window at Apple's discretion)
• Google Play Store purchases: subject to Google Play's refund process (48-hour automatic, then discretionary)

8. License Grant

Your use of the Application is governed by our End User License Agreement, available at fargeaux.com/eula. By using the Application, you agree to the EULA in addition to these Terms. In the event of conflict between these Terms and the EULA, the EULA prevails with respect to your license to use the Application.

In summary, you receive a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Application on compatible devices that you own or control, for personal, non-commercial purposes only.

9. Acceptable Use

You agree NOT to:

Violation of any of these provisions may result in immediate suspension or termination of your Account, with no refund obligation, in addition to any other remedies available to us under law. These obligations apply to every user of the Application and Website, including users accessing a free trial and users who have not created an Account. By accessing or using the Application or Website in any way, including any free trial, you agree to be bound by these obligations whether or not you have created an Account.

• (a) Copy, modify, distribute, sell, license, sublicense, or create derivative works of the Application, the Website, or any Content;
• (b) Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application;
• (c) Use any automated means (bots, scrapers, crawlers, data-mining tools) to access, collect, or extract content from the Application or Website;
• (d) Take screenshots, screen recordings, or other captures of Content for redistribution, public sharing, or republication;
• (e) Share, transfer, sell, or sublicense your Account credentials, entitlement, or access to any third party;
• (f) Use the Application or Website for any unlawful, fraudulent, or unauthorised purpose;
• (g) Interfere with or disrupt the Application's or Website's operation, security, or integrity;
• (h) Misrepresent your identity or your affiliation with any person or organisation;
• (i) Use the Application or Website to harass, defame, abuse, threaten, or otherwise harm any other person;
• (j) Circumvent any technical or operational measures we use to enforce these Terms.

10. Intellectual Property

All rights in the Application, the Website, and the Content are owned by or licensed to Bonnum Lux Group and are protected by Australian and international copyright, trademark, and other intellectual property laws.

The FARGEAUX name and logo are trademarks of Bonnum Lux Group, with applications filed at IP Australia (Classes 9 and 41) and pending in additional jurisdictions. Road sign imagery used in the Application may be subject to government copyright in the relevant country or jurisdiction and is used under applicable open government licences, fair dealing, fair use provisions, or other lawful permissions. Acknowledgement of source materials is provided within the Application where applicable. Other than the limited license granted to you in the EULA, no rights in the Application, Website, or Content are transferred to you under these Terms.

11. Privacy

Your use of the Application and Website is subject to our Privacy Policy, available at fargeaux.com/privacy. The Privacy Policy describes the personal information we collect, how we use and share it, and your privacy rights. By using the Application or Website, you acknowledge that you have read and understood the Privacy Policy.

12. Disclaimers

To the maximum extent permitted by applicable law, the Application, Website, and Content are provided "as is" and "as available" without warranty of any kind, whether express, implied, statutory, or otherwise. Bonnum Lux Group disclaims all warranties not expressly stated in these Terms or the EULA, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be lawfully excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or other applicable consumer protection legislation in your jurisdiction.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• (a) Bonnum Lux Group will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of business, or loss of goodwill, arising from or in connection with your use of the Application or Website;
• (b) Bonnum Lux Group's total aggregate liability to you under or in connection with these Terms, whether in contract, tort (including negligence), under statute, or otherwise, is limited to the greater of: (i) the amount you paid to Bonnum Lux Group in the twelve (12) months prior to the event giving rise to the claim; or (ii) AUD $200;
• (c) Nothing in this Section 13 excludes, restricts, or modifies any liability that cannot be lawfully limited or excluded under applicable consumer protection law.

14. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Bonnum Lux Group and its directors, officers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

This indemnification does not apply to the extent prohibited by applicable consumer protection law. We reserve the right to assume the exclusive defence and control of any matter for which you are required to indemnify us, in which case you agree to cooperate with our defence of such claim.

• Your breach of these Terms, the EULA, or the Refund Policy
• Your misuse of the Application, Website, or Content
• Your violation of any applicable law, regulation, or third-party right (including intellectual property and privacy rights)

15. Termination

We may suspend or terminate your Account or your access to the Application or Website at any time, with or without notice, if we determine in our sole discretion that:

You may terminate your Account at any time by contacting support@fargeaux.com. Termination by you does not entitle you to a refund except as provided in our Refund Policy or required by applicable law. Upon termination, your license to use the Application is immediately revoked, and you must cease all use of the Application and Website. Sections of these Terms that by their nature should survive termination (including Sections 10, 12, 13, 14, 17, 18, and 19) will survive.

• You have breached these Terms, the EULA, or applicable law
• Your conduct is harmful to other users, to us, or to third parties
• We are required to do so by law or regulatory order
• Termination is otherwise warranted in our reasonable judgement

16. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by posting an updated version at fargeaux.com/terms and updating the "Last Updated" date. Where required by applicable law, we will provide additional notice through the Application or by email.

Continued use of the Application or Website after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must cease using the Application and Website and may close your Account in accordance with Section 15.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Australian Capital Territory, Australia, without regard to its conflict of laws principles. The parties submit to the exclusive jurisdiction of the courts of the Australian Capital Territory for the resolution of any disputes arising under or in connection with these Terms.

Nothing in this Section 17 excludes, restricts, or modifies any right you may have under applicable consumer protection law to bring proceedings in a court of competent jurisdiction in your state, territory, or country of residence.

18. EU and UK Dispute Resolution

If you are a consumer in the European Union, the European Commission provides an online dispute resolution platform accessible at ec.europa.eu/consumers/odr. Bonnum Lux Group is not obliged to participate in alternative dispute resolution proceedings but you retain all rights to dispute resolution provided under your local consumer law.

If you are a consumer in the United Kingdom, you retain all rights to dispute resolution and complaint mechanisms available under UK consumer protection law, including via Citizens Advice and the Trading Standards regime.

19. General Provisions

• (a) Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
• (b) Waiver: No failure or delay by Bonnum Lux Group in exercising any right under these Terms will operate as a waiver of that right.
• (c) Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
• (d) Entire Agreement: These Terms, together with the EULA, Privacy Policy, and Refund Policy, constitute the entire agreement between you and Bonnum Lux Group regarding the Application and Website, and supersede all prior agreements and understandings.
• (e) Headings: Section headings are for convenience only and do not affect interpretation.
• (f) No Agency: Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between you and Bonnum Lux Group.
